The Software have been designed for use by individual customers, which term shall also include authorised representatives of the individual customers who would use website and software. a. You have attained majority in your jurisdiction (at least 18 years old in the case of India). If you are under the relevant age of majority in your jurisdiction, you may access the BFSAMC website/platform under the supervision of a parent or guardian, who in such a case will be deemed as the recipient / end-user of the Services for the purpose of these Terms and Conditions.

b. You are legally competent to contract, and otherwise competent to use the website/portal.

c. You have not been previously suspended or removed by BFSAMC, or disqualified for any other reason, from availing the Services.

The Services are not intended for use by minors. BFSAMC strongly encourages parents and guardians to consider using parental control tools to help provide a child-friendly online environment and to supervise the online activities of their minor children.

a. You shall provide accurate and complete information everywhere on the BFSAMC website/portal, based on which you will receive the services. Any registration information given to BFSAMC by you is true, accurate, correct, complete and up to date, to the best of your knowledge and belief. Any phone number used to register with the Services is registered in your name, and you might be asked to provide supporting documents to prove the same. You own sole responsibility for any consequences arising out of any inconsistency or inaccuracy of any information or data provided by you. This Site is intended solely for the use of Resident Indian(s), permitted Non-Resident Indians, Persons of Indian Origin, and Foreign Investors and other investors, permitted to invest in Mutual Funds and services offered by BFSAMC, as per prevailing laws & regulation established by SEBI & other regulatory bodies/ authorities. Nothing on this Site shall be considered a solicitation to buy or an offer to sell a security, or any other product or service, to any person in any jurisdiction where such solicitation, offer, purchase or sale would be unlawful under the laws of that jurisdiction. You agree and acknowledge that you are a citizen of India and hereby expressly waive the right to claim any remedy or benefits from, or enforce any rights against BFSAMC, under Information Technology Act, 2000 and rules made thereunder and/or any other such applicable rules/act/guidelines/regulations for the time being in force. In case you are Non-Resident Indian, Person of Indian Origin or a Foreign Investor who is permitted to invest in mutual funds in India as per applicable laws, you hereby expressly waive the right to claim any remedy or benefits from, or enforce any rights against BFSAMC under the Information Technology Act, 2000 and rules made thereunder and/or any other such applicable rules/act/guidelines/regulations for the time being in force.

c. You may view and access the content available on the BFSAMC website/portal solely for the purposes of availing the services, and only as per these Terms of Use. You shall not modify any content on the BFSAMC website/portal or reproduce, display, publicly perform, distribute, or otherwise use such content in any way for any public or commercial purpose or for personal gain.

d. You agree to use the Software and Services only for specified purposes that are permitted as per (a) the Terms of Use and (b) any applicable law, regulation and generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from India or other relevant countries). You shall not use Software and/or Services for any competitive or benchmarking purposes or for any such purposes that are disruptive to the BFSAMC Platforms and/or its business.

e. You shall not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile or otherwise exploit the BFSAMC website/portal or any portion of it unless expressly permitted by BFSAMC in writing. You shall not use any engine, software or any other mechanism for accessing, searching and /or navigating the BFSAMC website/portal.

f. You shall be solely responsible for all access to and use of the BFSAMC website/portal by anyone using the password and identification originally assigned to you whether or not such access to and use of BFSAMC website/portal is actually authorized by you, including without limitation, all communications and transmissions and all obligations (including, without limitation, financial obligations) incurred through such access or use. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you.

g. You shall not engage in any activity that interferes with or disrupts or damages the Software (or the servers and networks which are connected to the Software). BFSAMC reserves the right to initiate appropriate legal action against you for breach or threatened breach of your obligations under this clause.

h. You shall not make any commercial use of any of the information provided on the BFSAMC website/portal.

i. You shall not impersonate any person or entity, or falsely state or otherwise misrepresent your identity, age or affiliation with any person or entity. If any fraudulent transaction is done to misuse the BFSAMC website/portal including but not limited to situations where such transaction is done to generate personal gain and/or for any other commercial purpose, then we shall have a right to terminate your access and delist you from the BFSAMC website/portal.

j. You shall not upload any content prohibited under applicable law, and/or designated as “Prohibited Content” under Section 5.

k. You may discontinue the use of Services and request us to delete any information provided by you, by writing to us at service@bajajamc.com or calling us on + 91 20 6767 2500. We might connect with you in case we need any further details in order to respond to your request, subject to applicable laws allowing deletion of such information.

l. You shall indemnify BFSAMC for any claims, losses or damages, or for the costs of any regulatory or court proceedings suffered by Company as a consequence of your breach of this Agreement.

m. You explicitly agree that you are solely responsible for maintaining the confidentiality of login credentials and passwords associated with any log-in you use to access the Software and/or website/portal and store your confidential, personal and sensitive information. In no event shall BFSAMC be liable if your login credentials are compromised thereby resulting in breach of your personal, sensitive and/or confidential information.

n. You agree and acknowledge that if the information provided to BFSAMC by you, though the Software is not synced with the servers of BFSAMC, you may lose such information. Additionally, due to security concerns, you may not be able to access such information if they have been left unassessed for a certain period of time

o. BFSAMC offers its website/portal, Software and Services on as-is basis. BFSAMC has the sole right to modify any feature or customize them at its sole discretion and there shall be no obligation to make customization as requested by any User.

p. BFSAMC provides basic support for the Software and Services and will use, as far as possible, commercially reasonable efforts to make the Software and Services available 24 hours a day, 7 days a week, except for (i) technological errors, (ii) planned downtime, or (iii) any unavailability caused by circumstances beyond BFSAMC’s reasonable control, including without limitation, acts of God, acts of government, flood, fire, earthquakes, lockdown, civil unrest, acts of terror, strikes or other labour problems, or internet service provider failures or delays. BFSAMC takes no responsibility for any disruption, interruption or delay caused by any failure of or inadequacy in any of these limiting factors or any other factor beyond the control of the Company.

q. BFSAMC shall have the right, at its sole discretion, to suspend your ability to use or access the website/portal at any time while BFSAMC investigates complaints or alleged violations of this Agreement, or for any other reason.

r. BFSAMC reserves the right to add new functionality, remove existing functionality, and modify existing functionality to its website/portal as and when it deems fit, and make any such changes available in newer versions of its website/portal at its discretion. You may or may not be notified upon release of such newer versions and BFSAMC reserves the right to automatically upgrade you to the latest version of its Software, website/portal as and when it deems fit.

s. You acknowledge and specifically consent to BFSAMC or our respective affiliates and partners contacting you using the contact information you have provided to us at any time during your association with us for any purpose including but not limited to the following purposes, which will enable BFSAMC to deliver the Services to you and/or enhance the delivery of the Services to you:
• To obtain feedback regarding the Services;
• To contact you for offering new products or services offered by us.

t. You acknowledge and agree that you may be contacted for the above purposes, using any of the contact details provided by you including via emails, or any other electronic and internet-based means. In addition, you will be sent a one-time password via SMS to your registered mobile number, to verify your login on the BFSAMC website/portal using a mobile number. Two factor authentication as mandated by the SEBI Regulations would be adhered to.

u. You are solely responsible for the accuracy/authenticity of the bank account details provided by you and any other information requested during any of the process on the website. Any personal data whether provided by you or collected automatically when you use the service will be governed by our Privacy Policy. This data would also be used for rendering services to you at a future date. You confirm that you are the authorised user of such bank account details/ other payment details you share with us.

v. This site is intended to provide information about BFSAMC, and information associated with the services provided by BFSAMC. Site Content may refer to products or services that may not be available in your country. You should not construe anything on the site as a promotion or solicitation for any product or for the use of any product that is not authorized by the laws and regulations of the country in which you are located.

w. Because of the global nature of the Internet, you agree to comply with all local rules with respect to your online conduct, including all laws, rules, codes and regulations of the country in which you reside and the country from which you access this site, including without limitation, all laws, rules, codes, regulations, decrees, acts, orders, directives, legislation, bills and statutes pertaining to tax, contracts, intellectual property, securities, e-commerce, banking, technology, computers, fraud and privacy. In addition, you agree to comply with all applicable laws, rules, codes and regulations regarding the transmission of technical data exported from India

x. BFSAMC may call you for the purpose of obtaining your feedback on the Software and website/portal or for any other purpose. After taking your explicit consent, BFSAMC may also record and access such call recordings for quality control and training purposes. You agree and acknowledge that BFSAMC shall not be obliged to give effect to any suggestions made received from you in the form of feedback or review.

We reserve the right to refuse service or terminate accounts at our discretion, if we believe that you have violated or are likely to violate applicable law or these Terms and Conditions.

By proceeding to the Website, and/or using our services you represent that you voluntarily provide us with personal information including medical and financial information and consent to their collection, use and disclosure in accordance with this Privacy Policy.

o. copying or duplicating in any manner any of the BFSAMC content or other information available from the Software;

p. is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.

You also understand and acknowledge that if you fail to adhere to the above, we have the right to remove such information and/or immediately terminate your access to the Services and / or to the BFSAMC Platforms and/or website/portal. We shall also preserve such Prohibited Content for such period as may be required under applicable law for investigation purposes.

a. BFSAMC makes no express or implied representations or warranties about its Software or Services or website/portal and disclaims any implied warranties, including, but not limited to, warranties or implied warranties of suitability of any product. Company does not authorize anyone to make a warranty on behalf of BFSAMC.

b. In the event that BFSAMC promotes any product to you, please note that such product will be subject to the applicable risk factors, and you are responsible for undertaking an independent assessment regarding the suitability of such product, its risk reward analysis and its suitability for your purposes. Marketing or promotion of product should be considered as being for informational purposes only and shall not constitute expert advice on the suitability of such product for your specific investment needs.

c. In no event, BFSAMC or its affiliates shall be liable to you for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages arising out of or relating to: (i) these Terms and Conditions and Privacy Policy; (ii) your use or inability to use the BFSAMC services, website/portal, software; (iii) your use of any third party services you contacted through BFSAMC Platforms.

d. BFSAMC assumes no responsibility, and shall not be liable for viruses that may infect your equipment or any other damages to your equipment on account of your access to, use of, or downloading of any content from the website/portal/Software. You agree and acknowledge that if you are dissatisfied with the website/portal/Software, your only remedy is to discontinue using the website/portal/Software

e. In no event, including but not limited to negligence, shall BFSAMC, or any of its directors, officers, employees, agents or service providers (collectively, the “Protected Entities”) be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the website/portal/Software or the content, materials and functions related thereto, even if such Protected Entity has been advised of the possibility of such damages. In no event shall the Protected Entities be liable for or in connection with any content posted, transmitted, exchanged or received by you or on your behalf on or through the Software/website/portal.

f. Notwithstanding anything contained herein, in no event shall the total aggregate liability of the Protected Entities for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from the Terms and Conditions or your use of the Software exceed, in the aggregate Rs. 1000/-.

This section shall survive the termination of this Agreement and the termination of your use of our Services.

BFSAMC takes no responsibility for advertisements or any third-party material if posted on the BFSAMC Platform nor does it take any responsibility for the products or services provided by advertiser/seller/solicitor. Any dealings you have with advertisers in case found while using the Services are between you and the advertiser, and you agree that BFSAMC is not liable for any loss or claim that you may have against such advertiser/seller/solicitor. BFSAMC is not responsible for any money that has been debited from the bank account/debited by payment aggregator/debited by payment gateway service provider of the investor but not received by BFSAMC.

d. Inability to use public or private transportation and telecommunication systems.

e. Acts, decrees, legislation, regulations or restrictions of any government or public authority including any judicial determination.

Our obligations deriving from any contracts should be considered suspended during the period in which Force Majeure remains in effect and we will be given an extension of the time period for fulfilling these obligations by an amount of time we shall communicate to you, not being less than the time that the situation of Force Majeure lasted.

For change in law specifically, we reserve our rights to suspend our obligations under any contract indefinitely, and / or provide Services under revised Terms and Conditions.
